The establishment of NSPS dated back to 2003, when the US
Congress4 (Congress) gave its approval to the DoD to set up a flexible civilian
personnel management system that would help in attracting, retaining, and
rewarding employees based on their performance.
According to Melinda Darby, Assistant, G-1 for civilian personnel, “NSPS is
being established to make the civilian personnel management system more flexible
and to make the DoD a more competitive employer.”5 At the same time, the DoD also
aimed to maintain the security of the nation.

Donald Rumsfeld (Rumsfeld), then Defense Secretary, said,
“The most ambitious reform of its kind in a quarter-century, projected to
greatly enhance the effectiveness and security of our Nation for years to come.”6

However, DoD's implementation of NSPS met with
resistance from several federal labor unions.
The labor unions contended
that the NSPS did not focus on elements such as adverse actions,
collective bargaining, labor relations, third-party review, or
establishment of a National Security Labor Relations Board7. This, they
maintained, had resulted in the erosion of job security of the workers.
After several years of controversies including lawsuits from labor unions, the DoD
came out with new regulations in May 2008... |
